Duke granted gossip ban on ex- maids services

The Duke of Westminster, one of Britain’s wealthiest men, yesterday won a High Court injunction banning his former maids services from revealing details of his private life.

Frances Hewson, 51, earned £14,000 a year as the duke’s maids services at Eaton Hall, his country seat in Cheshire, until her dismissal last October. Neither party was in court for the hearing.

Tom Croxford, for the duke, told Mr Justice Stanley Burnton that “my client comes somewhat reluctantly to seek an injunction”. But recent newspaper articles featuring Mrs Hewson showed that she was thinking of writing a book or magazine articles about her time in the duke’s employ.

This would breach the confidentiality terms of her contract of employment and a verbal undertaking she had given earlier this year, said Mr Croxford.

Granting the injunction, the judge gave leave for Mrs Hewson, who was not represented, to apply to have it varied or discharged.

The duke, 50, whose wealth is estimated at £4 billion, authorised Mrs Hewson’s dismissal after complaints from other members of his staff about “malicious gossip”. She was sacked for gross misconduct after her activities caused “discontent and disharmony” below stairs.

After her dismissal Mrs Hewson, who had worked for the duke for seven years, lost her grace and favour cottage on the 11,000-acre estate. Earlier this month an employment tribunal in Liverpool unanimously ruled against her claim for unfair dismissal.

Mrs Hewson now works as a night cleaner on a business estate. She turned down an offer of £5,000 from the duke’s lawyers to settle the case before it went to the tribunal, and since losing the case has reportedly been offering to reveal details of the Westminster’s private lives to newspapers for money.

Mrs Hewson, a mother of two, was quoted as saying: “I have been branded as a gossip, so I might as well behave as one. This is a David and Goliath situation. It’s not me but I don’t feel I have much of a choice.”

She has already revealed that Natalia, the duke’s wife, ordered staff to position lavatory paper in the stately home’s 20 en suite bathrooms so that only two sheets were hanging down. Furniture in the grand drawing room had to be in a precise line with the obelisk in the courtyard, and bed linen in all the rooms had to be folded so that the “W” monogram on the sheets was not creased. Upstairs rooms had to be cleaned clockwise, claimed Mrs Hewson.

Before the High Court hearing a spokesman for the Grosvenor Estate said: “We have reminded her of her obligations of confidentiality in her contract of employment.

“The Grosvenor family have never sought publicity and are entitled to their private life. Therefore Mrs Hewson has given us no other option than to take out this injunction.”

Collecting Tax
You should collect state tax, plus any local (city, county, special purpose district, or transit) taxes on the amount you bill for your service.

Examples of Taxable Services
Tax is due on the charge to clean a home, office, warehouse, garage, restaurant, or any other building, or a swimming pool. For example, you should collect tax on your charges for such things as cleaning and straightening; washing windows, floors, walls, and ceilings; cleaning chimneys or air ducts; replacing light bulbs or fuses; picking up trash indoors or outdoors; and maintaining swimming pools.

Charges for minor repairs, adjustments, and maintenance of heating and air conditioning systems (for example, cleaning or changing filters) are subject to tax, if such services are done as part of your custodial service.

Charges for repair, remodeling, and restoration done on nonresidential buildings also are taxable. As an example, you should collect tax on the total charge, including labor and materials, to paint or hang wallpaper in an office.

Pressure washing is taxable as the restoration or maintenance of tangible personal property (see Rule 3.292). Pressure washing buildings, sidewalks, and parking lots is taxable as building or grounds cleaning (see Rule 3.356).

Swimming pool maintenance is a taxable real property service whether done on residential or nonresidential (commercial) property. Swimming pool maintenance includes testing, acid washing, adding and balancing chemicals, cleaning and changing filters, and vacuuming.

Examples of Nontaxable Services
There is no tax on the charges of a self-employed person who provides traditional household services such as housekeeping, babysitting, or cooking. For the charges to be exempt from tax, the person must be an employee of the household and not act as a subcontractor for a third party, such as a maid services

The tax exemption does not include other types of real property services provided by self-employed individuals to residential customers. For example, landscaping or pool cleaning services done at a residential household by a self-employed individual are taxable as real property services. See sections (a)(7) and (b) of Rule 3.356 relating to real property services.

Building maintenance and groundskeeping are not taxable when purchased by a contractor or a home builder as part of the improvement of real property with a new residential structure to be used as a residence, or when making an improvement to residential realty that qualifies as new construction. Materials, Supplies and Equipment
You must pay tax on all soap, cleaners, chemicals, materials, supplies, and equipment used to perform your services.

When performing taxable services, you can give your supplier a resale certificate instead of paying tax on goods that are transferred to the care, custody, and control of your customer as a part of your service. Examples of such items that are passed on to your customers include wax and furniture oil or polish, and toilet paper, paper towels, and hand soap left in the restrooms for your customers’ use.

When performing a nontaxable service, you must pay tax on these items.

Reselling a Cleaning Service
At times, you may subcontract with a third party, such as a maid services to clean for you. In this case, the third party will bill you, and you, in turn, will bill your customer. You can give the third party a resale certificate instead of paying tax on the sales price for the service. You must then collect tax from your customer on the total charge.

Franchise Description: Merry Maids Limited Partnership is the franchisor. The franchisor grants franchises for house and window cleaning services for customers who do not have the time nor the desire to clean regularly. The Merry Maids system is designed and best suited for residential customers. While the Merry Maids system provides thorough residential cleaning even for a customer desiring only a one-time visit, the system is not for disaster restoration or extraordinary cleaning projects. The franchisor does also offer a conversion franchise to those persons wishing to convert their existing residential cleaning business to a Merry Maids franchised business.

Training Overview: Franchisees or their manager must complete the Initial Training Program in Memphis, Tennessee, or at such other location as the franchisor may designate. If franchisees are a new franchisee to the Merry Maids network and no Initial Training Program is immediately available after they sign their agreement, the franchisor may allow them to attend a mentor office to assist their start-up. The franchisor usually holds an annual three-day National Seminar at a hotel/convention center at a designated location within the United States. The program for the National Seminar includes at least 15 hours of training sessions for franchise owners and managers. Franchisees must attend, at their own expense, the first National Seminar scheduled after they have signed the Franchise Agreement. The franchisor also holds Regional Meetings one or more times per year, at hotels in various cities. These meetings include at least six hours of training for franchise owners and managers. Franchisees or a designated officer or manager of the franchised business must attend at least two of the meetings offered each year, which includes the National Seminar and Regional Meetings. Territory Granted: The franchisee will receive a territory (Market) with a minimum of 15,000 to 35,000 Qualified Households for a Full-Sized Market, a minimum of 8,000 to 15,000 Qualified Households for a Mid-Sized Market, and up to 8,000 Qualified Households for a Small-Sized Market. A Qualified Household is a household with an average annual income of $75,000 or higher. In addition to Qualified Households, the franchisor will also consider total population and relative affluence in designating each Market, utilizing census data from SRC, LLC located in Orange, California. While the Franchise Agreement is in effect, the franchisor will not establish or license another to establish any other Merry Maids franchise within the Market. Except when advertising cooperatively with appropriate franchisees, franchisees cannot advertise or solicit sales or accept orders outside their Market. Franchisees may face competition from other franchisees, from the franchisor’s company-owned business, or from other channels of distribution or competitive brands that the franchisor controls.

Obligations and Restrictions: The franchisor recommends, but does not require, that franchisees personally supervise the franchised business. If franchisees do not personally supervise the business, or if they are a corporation, partnership, or limited liability company, they must employ a manager who will be responsible for direct, on-premises supervision of the business. The manager must have successfully completed the Merry Maids training program. Franchisees must offer and provide all the services required. If a customer outside of the franchisee’s Market is seeking cleaning services, the franchisee shall refer the request to the Merry Maids office which covers the customer’s area. Franchisees are required to follow the franchisor’s cleaning processes and use its cleaning products.

Term of Agreement and Renewal: The initial franchise term is for five years. If franchisees have complied with the Franchise Agreement and maintained the business in accordance with the OperationsManual, they will have the option of renewing the franchise for additional periods of five years each.

Financial Assistance: The franchisor does not offer direct financing. Its affiliate, ServiceMaster Acceptance Company (SMAC), does offer financing for up to 80% of the Initial Franchise Fee up to a seven-year period.

Asphalt tile: Try to mop every week using 1 cup of fabric softener in half a pail of water. Don’t flood the floor, since excess water can loosen adhesives and grout. Remove marks with fine-grade steel wool and liquid floor wax. Rub clean, then wipe with a damp cloth.

Brick flooring: Since brick is porous, keep the surface sealed and waxed with a commercial sealer. Mop after vacuuming. Use 1 cup of vinegar mixed in water to make it shine. Use a solvent-based wax, and use a wax stripper and brush to remove buildup as needed. Don’t use acids, strong soaps or abrasives.

Ceramic tile: Glazed ceramic is virtually stain proof; however, if it is unglazed, that means it’s porous and will need to be sealed. Don’t use harsh abrasives, acids or strong soaps on unglazed ceramic. Mop with all-purpose cleaner, and dry with a soft cloth. Strip unglazed ceramic once a year and rinse thoroughly afterward.

Concrete: Since concrete is very porous, it stains easily. Prior to sealing with a commercial sealer, sweep up loose dirt, and clean with an all-purpose cleaner. Use kitty litter to absorb oil and grease on your garage floor. Spread with a stiff broom, working from the back of the garage to the front, and then wash clean using a garden hose. If you need to use a heavy-duty floor cleaner, apply with a sponge mop, rinse and allow to dry.  Concrete floors can be kept clean easier if they are treated with an epoxy paint or other strong coating.

Flagstone and slate: Natural stone is rough and porous and should be sealed with a commercial sealer. Apply two thin coats of acrylic floor finish using a lamb’s wool pad, or apply paste with a floor polishing machine. Occasionally strip, rinse and reapply wax. Use a mop using either clear water, all-purpose cleaner or water with fabric softener.

Linoleum and vinyl: Prior to waxing, vacuum and mop, remove marks with a fine grade steel wool. Cleaning linoleum and vinyl floors is easy, but be careful of the products you use.  Solvent-based products, scouring, flooding and using very hot water are all bad for linoleum. The fastest way to clean the floor is with a one-step cleaner or polish, but the best way is to mop with all-purpose cleaner.

Marble: Non-polished marble is very porous, so seal it with commercial sealer. Mop it with clear water and all-purpose cleaner. You can also use 1 cup fabric softener to ½ gallon water, and use a self-polishing liquid wax. Strip occasionally, rinse and reapply wax. You also can use water-based wax or paste wax. If using a paste, test in a corner of the room to make sure the paste won’t discolor the flooring.

Cleaning hardwood floors

Many vintage and restored homes have original hardwood floors made of oak, maple or exotic woods like Brazilian cherry. Bamboo and other hardwood alternatives have become popular in recent years because they are made from a renewable source.

These floors can be cleaned by a daily sweep with a dust mop. Once a week, they can be damp mopped with a quality, liquid soap. There are also some cleaners that have gentle detergents and oils in them that will protect the wood’s natural finish. 

When mopping a wood floor, be careful not to get too much liquid on the floor at one time. Wood floors can be damaged by being overly saturated.

Finding a floor cleaner: Homeowners and business owners are fortunate because there are several ways that they can find a good floor cleaner. Check reviewes or chat with friends and family for a recommendation a quality professional floor cleaning company. Those who are hiring professional floor cleaners should always compare quotes from several different companies no matter how these companies are located.

Frequency: Most experts recommend that carpeted floors be professionally cleaned at least once a year if they experience a lot of foot traffic. Tile floors should be cleaned professionally when the grout gets stained. The frequency of cleaning can be adjusted depending on special circumstances.

Floor maintenance

When a pain in Beth Greer’s shoulder led her to a chiropractor nine years ago, she wasn’t that worried. After all, she led a healthy lifestyle: She watched her weight, meditated regularly, and ate mostly organic food. Greer’s chiropractor wasn’t worried either; he diagnosed her with a herniated disk. But after three sessions, not only was she not better, the pain was beginning to radiate down her arm and into her fingers.

An MRI revealed the true cause of Greer’s pain: a tennis-ball-size tumor in her chest. The good news was the mass was benign. Still, each of the three thoracic surgeons Greer saw strongly recommended she have it removed. One wanted to get at it by going in under her collarbone, one wanted to reach the mass through her armpit, and the third wanted to remove a rib to get the tumor from the back.

They all agreed on just one thing: The surgery was risky. Because the tumor was in such a nerve-packed place, there was a real possibility that removing it could cause Greer to lose feeling in her hand.

Greer opted out of the surgery, and instead focused on doing everything she could to support her body’s healing capacity. Curious by nature (she and her husband, Steven Seligman, owned the Learning Annex, a group of schools offering short-term classes on everything from relationships to real-estate), Greer decided to learn everything she could about her condition and discovered that tumors typically grow in response to irritation and inflammation. Eliminating environmental toxins that might be contributing to her tumor’s growth seemed like a practical first step.

First, she turned her attention to the conventional household cleaning products tucked away in her cabinets. “I’d look at a label and it would say ‘hazardous to humans and domestic animals,’” says Greer. “So why would anyone want to use that?”

She ultimately tossed her entire collection of toxic cleaning products and began making her own with ingredients like vinegar, baking soda and essential oil. She also swapped her commercial body-care products and makeup for nontoxic ones, and she cleaned up her already healthy diet by eating only whole, unprocessed foods — without any labels.

Nine months later, her tumor was gone. Completely. Although she can’t pin her results on any one environmental change, Greer’s confident that cutting down her exposure to toxins played a critical role — so much so that she’s made sharing that information with others a central part of her life.

Today, Greer consults professionally with others who want to detoxify their homes and offices. In 2002 she and Seligman sold the Learning Annex and she began writing about toxin-free living. The result is her book, Super Natural Home.

During her research for the book, Greer was shocked to learn that there’s no federal regulation of chemicals in household products. Rebecca Sutton, PhD, a senior scientist at the Environmental Working Group (EWG), explains, “In terms of household cleaners, neither ingredients nor products must meet any sort of safety standard, nor is any testing data or notification required before bringing a product to market.”

The average household contains about 62 toxic chemicals, say environmental experts. We’re exposed to them routinely — from the phthalates in synthetic fragrances to the noxious fumes in oven cleaners. Ingredients in common household products have been linked to asthma, cancer, reproductive disorders, hormone disruption and neurotoxicity.

Manufacturers argue that in small amounts these toxic ingredients aren’t likely to be a problem, but when we’re exposed to them routinely, and in combinations that haven’t been studied, it’s impossible to accurately gauge the risks. While a few products cause immediate reactions from acute exposure (headaches from fumes, skin burns from accidental contact), different problems arise with repeated contact. Chronic exposure adds to the body’s “toxic burden” — the number of chemicals stored in its tissues at a given time.

This toxic body burden is EWG’s chief concern about household chemicals. Sutton explains: “Our concern is daily, weekly, chronic exposure over a lifetime. Maybe if you’re exposed to a chemical a handful of times it wouldn’t cause harm, but some chemicals build up enough or cause enough harm in your body over time that it triggers some kind of disease outcome. The concept [of body burden] is that pollution is not just in our air and in our water — it’s also in us.”

No one can avoid exposure to toxic chemicals altogether, but it is possible to reduce it significantly. In the following pages, Greer, Sutton and other experts weigh in on the worst toxic offenders commonly found in household cleaning products, and offer ways to swap them for healthier, safer options.

  1. Phthalates
    Found in: Many fragranced household products, such as air fresheners, dish soap, even toilet paper. Because of proprietary laws, companies don’t have to disclose what’s in their scents, so you won’t find phthalates on a label. If you see the word “fragrance” on a label, there’s a good chance phthalates are present.

Health Risks: Phthalates are known endocrine disruptors.
